The notary public certifies: That the signer personally appeared before the notary public on the date and in the county indicated; The identity of the signer is confirmed; and that the signer acknowledged executing (signing) the document. This is second most common notarial act performed by a notary public. In the jurat, the notary public certifies: That the signer personally appeared before the notary public on the date and in the county indicated; That the signer signed the document in the presence of the notary public; That the notary public administered the oath or affirmation; and that the identity of the signer confirmed.

In states where Notaries are prohibited from certifying copies of documents, there is an alternative procedure called a copy certification by document custodian. This procedure allows a person in permanent possession of an original document to sign a written declaration that a copy of it is identical to the original, and take an oath or affirmation before the Notary.
The custodian’s signature is then notarized on the written declaration using jurat wording. In essence, a copy certification by document custodian is an affidavit signed and sworn to by the custodian with a jurat as the notarization. Remember, the custodian, not the Notary, guarantees that the copy is an authentic reproduction of the original.

A notary public may only certify copies of powers of attorney under Probate Code section 4307 and his or her own notary public journal. Certified copies of birth, fetal death, death, and marriage records may be made only by the State Registrar and by county recorders.

We offer free, easy to complete Power of Attorney forms. Simply fill in your name and the name of the person who will be your agent (attorney-in-fact) as well as a detailed description of what you need him/her to do for you as your agent. We are not lawyers and cannot give legal advice.

If you’ll be sending your notarized document out of the country you may need an Apostille. An Apostille is a certificate issued by the Secretary of State that proves the authenticity of a Notary’s signature and seal. MR Fingerprints will help you with the apostille of your documents with the secretary of state.
Expansion of Authentication Services: The California Secretary of State’s Los Angeles office has expanded its authentication services to include the authentication of the signatures of California notaries public, in addition to county and state official’s signatures.
$80 for the first apostille and $30 for each additional. (If needed)
Most county recorders and other authorities will accept a properly notarized document from an out-of-state Notary with no questions. On occasion, the receiving agency may require proof that the notarial signature and seal are genuine. This proof is called “authentication” or “legalization.”
Apostilles and Certifications only certify to the authenticity of the signature of the official who signed the document, the capacity in which that official acted, and when appropriate, the identity of the seal or stamp which the document bears. The Apostille or Certification does not validate the contents of the document.
